Terms and conditions
The terms of use for MyCM. They are written to be read, not to hide anything.
In force since September 2, 2026.
1. Who provides the service and who sells it to you
MyCM is a service provided by Geronimo Bergter, based in San Juan, Argentina. In this document, “we” means that, and “you” means whoever uses the service.
There is one distinction worth understanding before anything else, because it changes who you complain to, and it depends on where you pay from.
From outside Argentina, the seller is not us: it is Dodo Payments, acting as merchant of record. The sale is theirs, they issue the invoice, and they calculate and remit whatever tax applies in your country. We provide the service; they sell it.
From Argentina, we sell to you directly. Mercado Pago takes part only as the payment method: it processes the charge, but it is not the seller. We issue the invoice and we remit the tax.
In practice: for the product (how it works, what it makes, a bug, a question) write to b2studiomarketing@gmail.com, wherever you paid from. For billing (an invoice, a charge you do not recognise, a payment method), if you bought from outside Argentina then Dodo Payments’s terms also apply and the billing portal is the shortest route; if you bought from Argentina, write to us.
2. What the service does
MyCM makes graphics for social media out of two things you provide: a brand kit (colours, typefaces, logo, tone) and your own photo library. A language model writes the copy and picks which of your photos to use; the design is worked out by a fixed set of rules from your kit.
Two things the service does not do, worth stating plainly:
- It does not generate images with artificial intelligence. Every photo that appears in your pieces is a photo you uploaded.
- It does not publish anything on your behalf. It does not connect to your social accounts. You download the pieces and publish them yourself.
3. Your account
You need an account and an active plan to make content with your brand. You have to be at least 18, or of age in your country if that is different.
You are responsible for what happens with your account and for keeping your way in secure. If you suspect someone else got in, tell us.
One account is for one person or organisation. Sharing credentials so that several people use one plan and get around the quotas is grounds for suspension.
4. Plans, quotas and renewal
The current plans, with their prices and quotas, are on the plans page. Prices are stated in US dollars.
From outside Argentina, Dodo Payments may add whatever tax applies in your country; you will see it before confirming the payment. From Argentina the charge is made in pesos, converted at the rate at the moment of purchase, plus the applicable VAT; you will see the exact amount before confirming there too.
The monthly quota does not roll over: what you did not use this month does not carry into the next one. Once the quota runs out you can keep using the editor and downloading what you already made, but not make anything new until the next renewal.
Subscriptions renew on their own at the end of each period, at the price in force when you subscribed. You can cancel whenever you want from the billing portal; the plan keeps working until the period you already paid for is over.
If we change prices, we tell you by email at least 30 days in advance, and the change only takes effect at your next renewal. Never in the middle of a period you have paid for.
5. Your content and who owns what
What you upload stays yours. Your photos, your logo, your business details: we acquire no rights over any of it. You only give us the technical permission needed to run the service for you: to store it, process it and show it back to you. That permission ends when you delete it.
The pieces you make are yours too. You can use them commercially, with no limit on quantity, with no attribution and without asking us. They stay yours after you cancel the plan.
In return, you warrant that you have the right to use what you upload. Specifically: that the photos are yours or licensed to you, that the logo belongs to your brand, and that if there are identifiable people in the photos you have their permission. We do not check this, we cannot, but the responsibility is yours.
The software, the design system, the templates and everything that makes MyCM work stay ours.
6. Acceptable use
You may not use MyCM for:
- Illegal content, or content that promotes illegal activity.
- Content that harasses, defames or discriminates against a person or a group on the basis of origin, gender, religion, orientation, disability or any other characteristic.
- Sexually explicit material, or any content involving minors inappropriately.
- Impersonating another brand or person, or misleading advertising.
- Uploading material you do not hold the rights to, including stock photos without the corresponding licence.
- Automating the service from outside the app, reselling it as your own, or trying to extract the models or the design system.
The model that writes the copy has its own limits and may refuse to work on certain subjects. A refusal is not a failure of the service.
7. What to expect from the automatic part
The copy is written by a language model and the photo is chosen by a scoring system. Both get things wrong. Check every piece before publishing it. A wrong figure, a mistyped price or a badly worded promotion become yours once published.
We also do not guarantee that two different people will not get similar copy: if two bakeries both ask for a story about fresh pastries, it is to be expected that they look alike. The style is yours because it comes from your kit; the copy is a suggestion.
We use outside providers for this (Anthropic and Voyage AI). It is set out in the privacy policy. If one of them becomes unavailable, parts of the service may degrade for a while.
8. Availability
We do everything on our side to keep the service up, but we do not guarantee uninterrupted operation. There can be outages for maintenance, for our own failures, or for failures of the providers we depend on.
If a serious outage stops you using the service for a long stretch, write to us: we make up for it with plan time.
9. Limitation of liability
The service is provided “as is”. To the extent the law allows, our total liability for any claim related to MyCM is limited to what you paid in the 12 months before the event giving rise to the claim.
We are not liable for lost profits, lost customers, reputational harm or indirect damages arising from using or being unable to use the service.
None of this limits the consumer rights you have under mandatory law in your own country. Where such rights conflict with anything above, those rights prevail.
10. Cancelling and closing your account
You can cancel whenever you want from the billing portal, without explaining why. See the refund policy for what happens to what you already paid.
We can suspend or close an account that breaches these terms, generally after warning you and giving you time to put it right, unless it is something serious or illegal, where it can be immediate.
When your account closes you have 30 days to download whatever you want to keep. After that it is deleted. The pieces you already downloaded stay yours.
11. Changes to these terms
We may update them. If a change is substantial (it affects your rights, the price or the scope of the service) we tell you by email at least 30 days in advance. If you do not agree, you can cancel before it takes effect.
Minor changes, such as fixing confusing wording, are published with the date above updated.
12. Governing law
These terms are governed by the laws of Argentina. Any dispute is submitted to los tribunales ordinarios de la Provincia de San Juan, without prejudice to the courts that are available to you as a consumer where you live.
Before it gets there: write to us at b2studiomarketing@gmail.com. Almost everything gets sorted out that way.
